Lightfoot v. Cendant Mortgage Corp. , 580 U.S. ___ (2016), is a case of the United States Supreme Court clarifying whether Fannie Mae can be prosecuted in state courts. In a unanimous opinion written by Judge Sonia Sotomayor, the Court stated that the plaintiff may file a lawsuit against Fannie Mae in a state or federal court that "already has jurisdiction over the lawsuit."

The case arose when two mortgage borrowers filed suit in state court, which allegedly lacked in foreclosures and the sale of their homes. Relying on federal laws that give Fannie Mae the right "to prosecute and prosecute, and to complain and defend, in any court of competent jurisdiction, State or Federal" ("sued and prosecuted"), Fannie Mae filed a motion to move the case to federal court. The district court rejected the motion, but at the appeal, the US Court of Appeals for the Ninth Circuit stated that Fannie Mae sued the clause "granting jurisdiction to federal courts." District Judge Sidney H. Stein, who sits by appointment, disagrees, concluding that the sued and demanded clause requires an independent source for jurisdiction in cases involving Fannie Mae. Given the circuit sharing on this issue, the Supreme Court certifies by 2016.

Court Opinion

In unanimous opinion written by Judge Sonia Sotomayor, the Court overturned the decision of the Ninth Circuit and refused Fannie Mae's statement that it can automatically move any case to federal court. After reviewing clauses specifically sued by others, Judge Sotomayor stated that the phrase "competent jurisdiction court" allows the court with "existing subject matter jurisdictions" to listen to cases against Fannie Mae. As a result, Judge Sotomayor stated that federal law "allows lawsuits in any state or federal court that has been blessed with the subject's jurisdiction over the lawsuit."
